1. Handcrafted & Recyled Nature of Goods
By purchasing from Chuké Creations, you acknowledge and agree that:
- Product Uniqueness: All products are individually handcrafted utilizing 100% recycled luxury textile remnants and upcycled materials.
- Material Variations: Due to the nature of salvaged yarns and remnants, minor variations in color, texture, fabric weight, and stitching pattern are inherent characteristics of the design and do not constitute product defects.
- One-of-a-Kind Status: No two products are entirely identical. Photos on our website serve as a structural representation of the item, but the exact color gradients may shift.
2. Custom Sizing & Made-to-Order Items
- Customer Responsibility: Customers are entirely responsible for providing accurate physical measurements when selecting the “Custom Size” option at checkout.
- Production Timeline: Custom or made-to-order items typically require 7 to 14 business days for artisan production prior to shipment.
- Final Sale: Because custom-tailored pieces are altered to individual specifications, all custom-sized orders are strictly final sale and cannot be returned or exchanged.
3. Purchases & Payment
If you wish to purchase any product made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that:
- You have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase.
- The information you supply to us is true, correct, and complete.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product availability, errors in the description or price of the product, or errors in your order.
4. Intellectual Property
The Service and its original content, features, functionality, garment designs, and artistic concepts are and will remain the exclusive property of Chuké Creations and Chidimma Chuke. Our intellectual property and trade dress may not be used in connection with any product or service without the prior written consent of Chuké Creations.
5. Social Impact & Donations
Chuké Creations proudly pledges 10% of gross proceeds from specified collections to verified grassroots organizations supporting survivors of domestic violence. While we guarantee these distributions are made systematically to eligible non-profits, purchases made by individual consumers on this website do not constitute tax-deductible personal charitable donations.
6. Limitation of Liability
In no event shall Chuké Creations, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
